Part 1 of the Bill: Non-surgical procedures

What are the provisions in the Bill?

The Bill makes it an offence for people to provide a non-surgical procedure to a person under 18, and to provide a non-surgical procedure outwith permitted premises.
 
The Bill grants Healthcare Improvement Scotland (HIS) new powers to enforce the provisions of the Bill, including powers of entry, search and seizure. The Bill also creates an offence of obstructing an authorised person while undertaking enforcement duties.
 
A person convicted of an offence under the Bill is liable on summary conviction to a fine not exceeding level 5 on the standard scale (currently £5,000). This scale is set out in section 225 of the Criminal Procedure (Scotland) Act 1995.
