Yes their should be a code of practise that is robust and transparent. The current code of ethics is not fit for purpose.

9. What are your views on the proposal to introduce a duty of candour for constables as set out in section 3?

All police officers regardless of rank and including the chief officer current or retired have to be aware of the transparency, honesty and integrity of their role.
The fire arm officers to be accountable for their actions whilst on duty and off duty.
That their declaration to include “that I will follow the code of ethics for policing Scotland “

My view is the proposal for the SPA to be liable for the unlawful conduct on the part of the current and past chief Constable in the carrying out of their functions need to be included.

The PIRC should be able broaden the functions and to regulate the disciplinary procedures, not just misconduct investigations.

12. What are your views on the proposals to continue disciplinary procedures for gross misconduct, should an officer retire or resign?

Absolutely support officers regardless of rank and to include chief officers currently serving, retired or resigned should be liable to have disciplinary procedures of gross misconduct or law breaking to be brought against them. And fir them to be answerable.

There should be no restriction or any time limit after no steps can be taken against misconduct of procedures. Regardless of there being no additional criteria becoming known. Be it 5 or 30 years ago the misconduct occurred. No matter the rank of the officer currently or in the past, this would include a chief officer.

Any officer who has been found to be proven in a misconduct case, regardless of rank should be names and barred as well as added to a advisory list and the criteria for inclusion of an officer to either list.

The SPA should not continue to decide cases relating to senior officers. A independent panel should be the the ones to determine misconduct cases against senior officers and to include chief officers if they have been suspected or identified of misconduct. With the panel being a greater mix of of non- members than police.

My view on the proposals to clarify the PIRCs investigation powers in investigatory powers in relation to criminal conduct and incidents involving deaths of serving police officers is no matter if they are currently a on duty officer.
The powers of the PIRC to include personnel who have left the service who may not of been on duty at the time of the incident. Or did not become an officer until after the incident took place. To include any officer of any rank and include a chief officer serving or retired.

Any citizen or police officer can make a relevant complaint against any officer of any rank to include the rank of chief officer current, retired or resigned to the PIRC in any circumstances within or outside their working hours.

My view is the PIRC should have the statutory power to take over investigation of complaints being dealt with by the chief Constable or the SPA under the circumstances set out in section 12. This will ensure accountability of these new proposals.

Proposal of a statutory advisory board for the PIRC Is a must as policing, procedures, complaints are forever changing and evolving. So this needs to be taken into account with a eye on the future.

I feel this has been a long time coming. The people of Scotland in the majority have little faith in the policing of Scotland. There have been so many proven cases of miscarriages of justice both in the past and currently. The police in Scotland have been a law onto themselves for too long. With complaint’s being ignored or brushed under the carpet. With no known accountability being acknowledged.
This has been identified be Lady Elish Angiolini and what has resulted in the recommendations on her findings.

Yes. Should a police officer of any rank and to include past and present chief officers be found to be guilty of misconduct, then the loose their pension package. They are sanctioned as to any other citizen would be if they were found guilty on a similar misconduct.
